The US Department of Justice, just like we say the Law Ministry here in India, similarly the US Department of Justice there has formally dropped all criminal fraud charges against Gautam Adani and his nephew Sagar Adani, and the entire case has been closed permanently.

This allegation is that America is saying this corruption took place inside India because Gautam Adani wanted some solar power contracts from the Indian Government, and to secure those contracts
, this 250 million dollar bribe was given by Gautam Adani’s company to Indian officials, the government officials inside India, and the prosecution’s claim was that this entire payment was hidden from international investors, and the Adani linked companies raised this much money from the global market—meaning a complete fraud. They told the world, the investors in America, that look, we are getting such huge contracts inside India. Generally, what happens, suppose there is a company, if it wants to raise money from the public, it will show that look, we have such a huge business, the Indian Government is giving us this contract. If you don’t show that, why would anyone give you money? So America was basically saying that Gautam Adani intentionally secured these kinds of contracts by giving bribes, which was hidden from American investors, and it was shown that look, we are getting these contracts, and on that basis, this money was raised. That is why the matter comes under the jurisdiction of America. Okay, why is this solar project important? Because it is being said that a contract for 12 gigawatts of solar power generation was given to Adani here, and in India, you are seeing that many such contracts are being given to different businesses here. So that more focus is placed on solar power, and more electricity can be generated from there. Now, as I was telling you, why was the US claiming jurisdiction? Because the point comes down to this, America is saying that corruption happened inside India, so then the question arises that if a case has to run, it should have run in India.
Then why is America doing it? Because the matter involves US investors. Gautam Adani raised capital by selling shares or bonds of his company, so he raised capital from US investors by saying that we are getting this and that contract. But there was a major catch in this contract. This is the allegation. And besides this, the US financial system was used in the transaction of money. In securities fraud law, this very thing is stated that if someone misleads investors inside the US, then all these laws come into play. So this is called extra-territorial jurisdiction. On that very basis, America was saying that a case should run against Gautam Adani here. And what exact charges were leveled? Securities fraud, that you misled investors. Wire fraud, meaning the electronic system was used for payments. Conspiracy, meaning illegal planning was coordinated here, and besides this, there are several things. The issue of bribery, hiding evidence. So the prosecution’s allegation is basically that anti-corruption assurances were falsely given here. Bribery was running parallelly in India about which America was unaware at that time. The first reason being stated here is a weak jurisdictional basis. Adani’s legal team probably argued in court that see, the matter ultimately belongs outside America, the US government is unnecessarily trying to stretch this entire case. Meaning, this matter does not fall under US jurisdiction, they are forcibly bringing it into this. So that is why this case should be dismissed. One thing is that Adani’s entire legal team must have presented their point inside America. Then the second is a lack of strong evidence. See, what happens is that when it comes to a criminal case, you need very solid proof. Beyond reasonable doubt. So it is possibly that the lawyers in America, the lawyers of the American government, were probably not able to present very strong evidence against the Adani Group. Meaning see, what happens is that even if corruption has occurred somewhere, ultimately you have to prove it in court, right? It could be that the officials there were not able to prove this thing because they probably did not have that strong evidence.
So because of this also, what happens? Many times the court says that look, there is no real strength in this case. Right? Then there is another reason, Reason 3, which is being stated as the political change. Because when was this allegation leveled? When Biden was the President. But now Donald Trump has come. Now Donald Trump basically says that look, this corporate prosecution is not right. The white-collar enforcement priorities here should be reduced, a business-friendly approach should be adopted.
